These Terms of Service (the "Terms") govern your access to and use of this website and your purchase of products and services from Mphong LLC, doing business as Astro Fazz ("Astro Fazz," "we," "us," or "our"). Our store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to offer our products and services to you.

By visiting our website, creating an account, submitting content, or purchasing from us, you agree to these Terms and to the policies linked in them. If you do not agree, do not use the website or place an order.

1. Eligibility and account information

You must be at least the age of majority where you live, or use the website with the permission and supervision of a parent or legal guardian. You agree to provide current, complete, and accurate account, billing, personalization, and shipping information and to update it when necessary.

You are responsible for protecting your account credentials and for activity conducted through your account. Contact us promptly if you believe your account has been used without authorization.

2. Store use and prohibited conduct

You may use the website only for lawful personal or organizational shopping purposes. You may not:

• violate any applicable law or the rights of another person;
• upload malicious code or interfere with the security or operation of the website;
• scrape, copy, reproduce, resell, or exploit the website or its content without written permission;
• submit false, misleading, abusive, defamatory, obscene, discriminatory, or unlawful material;
• impersonate another person, commit fraud, or use another person's payment information without authorization; or
• use the website or our products to infringe copyrights, trademarks, privacy, publicity, or other rights.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

3. Products and availability

We make reasonable efforts to describe and display products accurately. Colors, scale, placement, texture, and other visual details may vary because of screen settings, the production process, material characteristics, sizing, and the handmade or made-to-order nature of personalized products. Product images and mockups may be illustrative and may not represent exact scale or placement on every size.

Products, designs, options, prices, and availability may change without notice. We may limit quantities, discontinue products, or decline an order where permitted by law.

4. Personalization instructions and customer approval

You are responsible for reviewing all names, dates, numbers, sizes, colors, spelling, grammar, capitalization, images, and other personalization details before placing your order. We generally produce personalized items using the information submitted with the order and may not independently verify or correct it.

If we provide a proof or request clarification, you are responsible for responding within the stated time. Production and delivery estimates may be delayed while we wait for your response. Approval of a proof confirms that the personalization, layout, and content shown are acceptable. Minor production variations are not defects.

Changes or cancellations are not guaranteed after an order is placed because production may begin quickly. Contact us immediately if you notice an error.

5. Customer content and permissions

"Customer Content" means names, text, photographs, artwork, logos, trademarks, school or organization identifiers, and other material you submit for personalization, review, or support.

You retain any rights you hold in your Customer Content. You grant us and our production, technology, and fulfillment providers a limited, non-exclusive, worldwide license to host, reproduce, modify, format, and use Customer Content only as reasonably necessary to review, produce, fulfill, deliver, and support your order, comply with law, and prevent fraud.

You represent and warrant that:

• you own Customer Content or have all permissions required to use and provide it for the ordered product;
• our use of it to fulfill your order will not infringe intellectual-property, privacy, publicity, contractual, or other rights; and
• it does not contain unlawful, harmful, hateful, defamatory, or otherwise prohibited material.

Ordering an item containing a school, team, club, company, organization, character, celebrity, or other protected name, logo, or artwork does not mean that we are affiliated with or endorsed by that rights holder. We may request evidence of permission, reject content, cancel an affected order, or remove material when we reasonably suspect infringement or unlawful use. You are responsible for claims arising from Customer Content you were not authorized to use.

We will not use Customer Content in advertising or public promotional materials without additional permission, except for content you intentionally publish through a public review or social-media interaction subject to Section 14.

6. Orders and acceptance

An order confirmation acknowledges that we received your order; it does not necessarily mean that we accepted it. We may verify payment and order details before acceptance. We may refuse or cancel an order because of suspected fraud, unauthorized content, pricing or listing errors, product unavailability, shipping restrictions, or other legitimate reasons.

If we cancel an order after payment, we will refund the canceled amount to the original payment method, subject to payment-provider processing times. We may limit orders that appear to be placed by dealers, resellers, or distributors.

7. Prices, payment, taxes, and promotions

Prices are shown in the currency displayed at checkout and may change without notice. The total presented at checkout may include shipping charges and applicable taxes. You authorize us and our payment providers to charge the payment method you submit for the order total.

Discounts and promotions are subject to their stated conditions, availability, and expiration dates. Unless expressly stated otherwise, promotions cannot be combined, applied retroactively, redeemed for cash, or transferred.

8. Production, shipping, delivery, and risk

Our current processing and estimated delivery information is available on our Shipping & Delivery page. Products may be manufactured, personalized, or fulfilled by third-party partners in the United States, Vietnam, China, or other locations disclosed for the applicable product or shipment. Items from the same order may arrive in separate packages, from different origins, and at different times.

Processing and transit times are estimates, not guaranteed delivery dates, unless we expressly state otherwise. Holidays, weather, carrier disruptions, customs or border processing, address errors, customer-response delays, and other events outside our reasonable control may affect delivery. Any import duties, taxes, brokerage fees, or similar charges will be handled as stated at checkout or in the applicable Shipping & Delivery information and as required by law.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if an address is incorrect; we cannot guarantee changes after production or shipment begins. Additional costs caused by an incorrect or undeliverable address may be your responsibility where permitted by law.

Risk of loss and title pass as provided by applicable law. If tracking reports a delivery but you cannot locate the package, contact the carrier and then contact us so we can review the available information.

9. Returns, replacements, refunds, and cancellations

You may request a return of an eligible item, including a personalized or made-to-order item, within 30 days after delivery if you are not satisfied with your order. Return eligibility, item-condition requirements, return methods and costs, exceptions, refund timing, and the procedure for damaged, defective, or incorrect items are described in our Returns & Refunds page, which forms part of these Terms.

Contact us before sending anything back so we can provide the return instructions and the correct return address for the fulfillment partner assigned to your order. Do not send returns to our business mailing address unless we expressly instruct you to do so.

You may request an order change or cancellation within 24 hours after placing the order. Approval is not automatic, and a request may no longer be possible if production or shipping has already started.

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.

10. Intellectual property

The website and its original content—including text, graphics, store-created designs, photographs, logos, layout, software, and branding—are owned by or licensed to us and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.

You may use the website for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, create derivative works from, sell, license, or commercially exploit our content without prior written permission. Rights in third-party names, logos, designs, and other material remain with their respective owners.

If you believe content on the website infringes your rights, contact us with enough information to identify the work, the challenged material, your contact details, and the basis for your claim.

11. Accuracy of website information

Website information is provided for general information and may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, shipping, availability, or other matters. We may correct errors and update information as permitted by law. If a correction materially affects an accepted order, we will provide any notice or remedy required by applicable law.

12. Third-party services and links

The website may use or link to services operated by Shopify, payment processors, carriers, social platforms, and other third parties. Their services are governed by their own terms and privacy practices. We are not responsible for third-party websites or services that we do not control. Review their terms before using them or completing a transaction.

13. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy. Shopify and other service providers may process information as described in their own privacy notices. By using the website, you acknowledge these privacy practices.

14. Reviews, feedback, and public submissions

If you voluntarily post a public review, tag or mention us on social media, or submit feedback for publication, you grant us a non-exclusive, worldwide, royalty-free license to reproduce, display, adapt, and share that public submission in connection with our store and marketing, subject to applicable law. You confirm that you have the necessary rights and that the submission is truthful and does not violate another person's rights.

This license does not apply to private order files or Customer Content submitted only for production. You may ask us to stop future marketing use of your public submission by contacting us, although removal from materials already produced or from third-party reposts may not always be possible.

15. Disclaimer of warranties

To the fullest extent permitted by law, the website and services are provided on an "as is" and "as available" basis. We do not warrant that access will always be uninterrupted, secure, or error-free. Products are subject only to warranties expressly provided by us or required by law.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, we and our owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities arising from your use of the website, products, or services.

To the fullest extent permitted by law, our aggregate liability for a claim relating to an order will not exceed the amount you paid us for the product giving rise to that claim. These limitations do not apply where liability cannot lawfully be limited, including any liability that applicable law expressly makes non-excludable.

17. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless us and our owners, employees, contractors, service providers, and affiliates from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the website, your material breach of these Terms, or Customer Content that violates another person's rights. This section does not require you to indemnify a party for its own unlawful conduct where prohibited by law.

18. Suspension and termination

You may stop using the website at any time. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or misuse the website. Provisions that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, liability limits, indemnification, and dispute provisions—will survive.

19. Severability, waiver, and entire agreement

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. These Terms and the policies incorporated by reference constitute the entire agreement between you and us concerning the website and orders, except for any additional written terms expressly agreed for a specific transaction.

20. Governing law and disputes

These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles, except where the mandatory consumer laws of your place of residence apply. Before filing a formal claim, please contact us and provide a reasonable opportunity to resolve the issue informally.

Any legal proceeding that may lawfully be subject to an agreed venue will be brought in a state or federal court with jurisdiction in Montana. No arbitration or class-action waiver has been added to these Terms.

21. Changes to these Terms

We may update these Terms by posting a revised version on this page and changing the effective date. Changes apply prospectively unless applicable law permits otherwise. Your continued use of the website after an update means you accept the revised Terms.
